These Terms of Use (“Terms”) govern your use of myclarityproject.org, public forms, informational materials, and website-based services provided by The Clarity Project. By using the website, you agree to these Terms. If you do not agree, do not use the website.
1. Eligibility and Appropriate Use
You may use the public website only for lawful purposes. The career-transition program is intended for adults. You are responsible for ensuring that information you submit is accurate enough for the purpose for which it is provided and that you have authority to provide it.
2. Nature of the Program
The Clarity Project is designed to help participants understand where they fit, build a focused career strategy, develop skills to work that strategy, and learn from results. Program content may include self-reflection, assessments, worksheets, coaching input, facilitated group discussion, career-search strategy, outreach practices, accountability, and related educational material.
Career decisions remain your responsibility. Information provided through the site or program is educational and does not replace individualized legal, tax, financial, mental-health, medical, immigration, employment-law, or other licensed professional advice.
3. No Employment or Outcome Guarantee
We do not guarantee job offers, interviews, compensation levels, placement, employer response, hiring decisions, promotion, business results, or any specific career outcome. Labor markets, employers, individual circumstances, performance, timing, economic conditions, and many other factors are outside our control.
4. Participant and Visitor Conduct
You agree not to:
- use the site in violation of law or the rights of others;
- attempt unauthorized access to accounts, servers, administrative tools, or restricted content;
- interfere with website security, rate limits, anti-spam controls, payment systems, or normal operation;
- introduce malware, malicious scripts, automated abuse, scraping that materially disrupts the service, or fraudulent transactions;
- misrepresent your identity or authority;
- submit confidential information belonging to an employer or another person without authorization;
- harass, threaten, discriminate against, or unlawfully target participants, coaches, volunteers, staff, donors, or other users; or
- copy, redistribute, sell, publish, or commercially exploit protected program materials except as expressly allowed.
5. Information You Submit
You retain responsibility for information and materials you submit. You grant The Clarity Project permission to use submitted information as reasonably necessary to respond to you, administer the program, process a donation, operate the website, protect the service, and satisfy legal obligations.
Do not submit passwords, full payment-card numbers, Social Security numbers, protected employer information, medical records, or other unnecessary highly sensitive material through public website forms.
6. Intellectual Property
Unless otherwise stated, the website’s branding, design, text, graphics, program frameworks, worksheets, educational material, downloadable resources, and other original content are owned by or licensed to The Clarity Project and are protected by applicable intellectual-property laws.
Participants may use program materials for their own personal career-transition work unless a specific resource states different terms. You may not reproduce, sell, publish, sublicense, distribute, create competing commercial materials from, or publicly post substantial portions of protected program content without written permission.
7. Third-Party Content, Tools, and Links
The website may reference employers, professional networks, assessment tools, payment providers, social networks, partner organizations, or third-party resources. References are provided for convenience or program use and do not constitute a warranty or endorsement of every third-party statement, practice, product, availability, or outcome.
Third-party services are governed by their own terms and privacy policies.
8. Donations and Payments
Donations are processed through the ecommerce/payment services configured for the website. You agree to provide accurate transaction information and to use only a payment method you are authorized to use.
Payment-card credentials are handled by the applicable payment gateway rather than custom theme storage. Transaction providers may impose their own terms, authentication, fraud screening, currency, fee, refund, dispute, or processing rules.
Recurring giving
If recurring giving is offered, the checkout will identify the recurring frequency before you authorize it. Recurring charges continue according to the terms presented at checkout until canceled, completed, or otherwise ended through the available provider/account process or applicable support channel.
Refund and cancellation requests
Donations are intended as voluntary gifts. If you believe a donation was made in error, was unauthorized, or requires cancellation, contact [email protected] promptly. Any refund, cancellation, chargeback, or recurring-gift adjustment is subject to applicable law, the transaction status, the payment provider’s capabilities and rules, and The Clarity Project’s accounting obligations.
Tax treatment
Nothing on the website is tax advice. The tax treatment or deductibility of a contribution depends on the organization’s status, the nature of the payment, the donor’s circumstances, and applicable law. Consult your own tax adviser when necessary and retain any receipt provided for your records.
9. Matching-Gift Opportunities
A displayed matching opportunity is subject to the current matching pool, eligibility terms, timing, completed-payment status, and any campaign-specific conditions. A displayed estimated match is not a guarantee until the applicable transaction and matching conditions are satisfied. Once matching funds are exhausted, later gifts may remain fully accepted without being matched.
10. Website and Program Availability
We may change, suspend, limit, discontinue, or update website features, program schedules, content, eligibility, session structure, resources, or availability. Maintenance, hosting issues, security incidents, provider outages, or other events can interrupt access.
11. Privacy
Your use of the website is also subject to our Privacy Policy and Cookie Policy, which explain website data practices and cookies in more detail.
12. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis. We do not warrant uninterrupted operation, error-free content, universal suitability, employer response, or a specific career result. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
13. Limitation of Liability
To the maximum extent permitted by applicable law, The Clarity Project and its directors, officers, employees, coaches, volunteers, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use, third-party services, career decisions, loss of opportunity, data loss, or inability to access the service, except to the extent liability cannot legally be limited.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
14. Responsibility for Misuse
To the extent permitted by law, you are responsible for losses, claims, or expenses arising from your unlawful misuse of the website, infringement of another person’s rights, fraudulent activity, or material violation of these Terms. This section does not waive rights that applicable consumer law does not allow you to waive.
15. Suspension or Termination
We may restrict or terminate access to website or program resources when reasonably necessary to protect participants, staff, systems, intellectual property, payment integrity, legal compliance, or the security and proper operation of the service.
16. Governing Law and Mandatory Rights
These Terms are governed by applicable law in the jurisdiction in which The Clarity Project is organized and operates, without overriding mandatory consumer or privacy protections that apply based on your location. Any mandatory consumer, privacy, employment, or other statutory rights that apply to you remain unaffected to the extent they cannot lawfully be waived.
17. Changes to These Terms
We may update these Terms when the website, program, donation features, vendors, or legal requirements change. The current version will be posted on this page, and continued use after an update constitutes acceptance to the extent permitted by law.
